1. Agreement to Terms
By accessing and using the EcoCultures website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
EcoCultures provides ecological landscaping services including native plant installation, habitat restoration, stormwater management, and related landscape design and maintenance services in southern Ontario.
3. Project Estimates and Pricing
All project estimates are valid for 30 days from the date of issue. Pricing is subject to change based on material costs, site conditions, and project scope modifications. Final pricing will be confirmed in writing before work begins.
4. Payment Terms
Payment terms will be outlined in individual project contracts. Typically, a deposit is required before work begins, with progress payments and final payment upon project completion. Late payments may be subject to interest charges.
5. Project Modifications
Any changes to the agreed-upon project scope must be submitted in writing and will be subject to additional charges. We reserve the right to adjust timelines and pricing for scope changes.
6. Site Access and Conditions
The client is responsible for providing clear and safe access to the work site. Any underground utilities, irrigation systems, or other site conditions that may affect work must be disclosed before project commencement. We are not liable for damage to unmarked or undisclosed site features.
7. Plant Warranties
Native plants are guaranteed for one growing season from the date of installation, provided that proper care and maintenance instructions are followed. Warranty does not cover plant loss due to extreme weather events, animal damage, neglect, or client modifications to the site.
8. Weather and Delays
Project timelines may be affected by weather conditions, material availability, or unforeseen site conditions. We will make reasonable efforts to communicate delays and adjust schedules accordingly.
9. Cancellation Policy
Projects may be cancelled with written notice. Cancellations made less than 48 hours before scheduled work may forfeit the deposit. Materials already ordered or work completed will be charged at cost.
10. Liability
EcoCultures carries appropriate liability insurance for landscaping work. We are not responsible for damage resulting from client-directed changes, pre-existing site conditions not disclosed, or events beyond our reasonable control.
11. Photography and Marketing
We reserve the right to photograph completed projects for portfolio and marketing purposes unless the client specifically requests otherwise in writing.
12. Intellectual Property
All landscape designs, plans, and related materials remain the intellectual property of EcoCultures unless otherwise agreed in writing.
13. Governing Law
These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
